Waste Management Inspections – essential or unacceptable?

According to the Austrian Landfill Ordinance of 2004, pre-treatment of specific kinds of waste is mandatory to achieve the high quality standards for landfilled residues.

In the year 2004, the Division of Waste and Material Flow Management of the Regional Government of Styria launched a landfill-inspection program for the province of Styria. The goal of this program is to ensure that activities of landfill operators are in accordance with the legal requirements. Since 1st January 2004 only a maximum total organic carbon (TOC) content of 5 % per weight for waste to be deposited on mass-waste landfills is allowed. Only waste from mechanicalbiological pre-treatment (MBT) which is deposited in separated compartments of mass-waste landfills, to the extent that it’s upper calorific value, determined from the dry substance, does not exceed 6,000 kJ/kg, is excepted from this requirement. The mixing of waste from mechanical- biological pre-treatment with materials or waste of low calorific value, in order to meet the above-mentioned limiting value, is not permitted.

Like all public international law treaties, the Paris Climate Accords rely on national law for their implementation. The success of the agreement therefore depends, to a large extent, on the stepstaken or not taken by national governments and legislators as well as on the instruments and mechanisms chosen for this task. Against this background, the present article compares different approaches to the implementation of the Paris Agreement, using court decisions as a means to assess their (legal) effectiveness.
