Strategies for the Implementation of the EU Landfill Directive in Different Member States

A comprehensive evaluation of the status and application of the EU Landfill Directive on bio-degradable municipal solid waste BMW management and the reduction of these materials being landfilled is currently ongoing at EU level on behalf of the Commission. From the case-studies surveyed below we can summarize that separate collection schemes for biodegrad-able packaging (i.e. paper and cardboard) and of food- and garden waste is already well established in Central Europe and rapidly growing in different countries (Italy, Spain, U.K.).

Some advanced member states are already able to achieve the reduction targets of BMW from landfilling for 2016 as defined in Art. 5 of the Landfill Directive, in most cases by applying a combined set of measures and instruments (i.e. separate collection, obligations for pre-treatment, etc.). Most countries, especially those belonging to the New Member States, are in the starting/developing phase of a BMW management strategy and are planning to develop a massive treatment capacity for biowaste (both composting, MBT, anaerobic digestion).

Like all public international law treaties, the Paris Climate Accords rely on national law for their implementation. The success of the agreement therefore depends, to a large extent, on the stepstaken or not taken by national governments and legislators as well as on the instruments and mechanisms chosen for this task. Against this background, the present article compares different approaches to the implementation of the Paris Agreement, using court decisions as a means to assess their (legal) effectiveness.
