Reform of the Common Agricultural Policy and Groundwater Protection 

The reform of the common agricultural policy (CAP) contents the opportunity to secure income in agriculture as will as implementing necessary improvements for sustainable environmental protection i. e. protection of drinking water sources. 

The following proposals from the Midterm review are essential: Cross compliance regarding food quality and safety as well as environmental protection, farm related audits and modulation of direct aid payments to rural development as a second pillar of the CAP. Reduction of Nitrate pollution of groundwater for example shows, how improvements for water protection could be implemented by a clear definition of duly agricultural practice including improvements for water protection as well as aspects of feasability in agriculture. If nitrogen emissions are below farm-specific standards by custum-made measures of a catalogue of best management practice, these environmentel service can be honored by EU-Subsidies. This link between agricultural policy and desired environmental service saves income for farmers – an essential aspect regending the EU-east enlargement.

Like all public international law treaties, the Paris Climate Accords rely on national law for their implementation. The success of the agreement therefore depends, to a large extent, on the stepstaken or not taken by national governments and legislators as well as on the instruments and mechanisms chosen for this task. Against this background, the present article compares different approaches to the implementation of the Paris Agreement, using court decisions as a means to assess their (legal) effectiveness.
