The provisions implementing the European emissions trading scheme in Germany include an option for existing facilities to be treated as newly installed facilities; by exercising the option these facilities are entitled to obtain additional emission certificates.
Since this option has been exercised by an unexpectedly high number of facilities the German overall emission budget is likely to face a shortage of some 42 million tonnes of carbondioxide in the first trading period 2005–2007. This article gives an overview of some of the most crucial legal questions arising with regard to the interpretation of this provision.

Like all public international law treaties, the Paris Climate Accords rely on national law for their implementation. The success of the agreement therefore depends, to a large extent, on the stepstaken or not taken by national governments and legislators as well as on the instruments and mechanisms chosen for this task. Against this background, the present article compares different approaches to the implementation of the Paris Agreement, using court decisions as a means to assess their (legal) effectiveness.
