Substitute Fuels: Co-Incineration in Cement Works and Coal-Fired Power Plants in Europe

The co-incineration of substitute fuels in cement works and coal-fi red power plants increasingly gains importance in Europe. Reasons for this are given on the one hand the reduction of CO2- emissions and on the other hand the substitution of coal by cheaper fuels.

Furthermore the landfill directive lead to a significant reduction of deposited municipal waste in some countries where by the thermal treatment and thereby also the co-incineration gained in relevance and will furtherincrease. In the cement market a high competition intensity is showing in some of the analysed countriesbecause of the declining demand for cement and clinker that lead to operators of cement workshaving to produce especially costefficient. Waste-derived fuels such as used tires and prepared municipal and commercial waste because of the cost structure already account for an average Proportion of more than 60 percent of fuels in Germany, the Netherlands and Austria.

Like all public international law treaties, the Paris Climate Accords rely on national law for their implementation. The success of the agreement therefore depends, to a large extent, on the stepstaken or not taken by national governments and legislators as well as on the instruments and mechanisms chosen for this task. Against this background, the present article compares different approaches to the implementation of the Paris Agreement, using court decisions as a means to assess their (legal) effectiveness.
