Required Drivers for Resource Efficiency in Waste Management

Waste is often referred to as a resource in the wrong place. The Austrian Waste Management is among the pioneers in the use of this resource worldwide.

However, the existing system (legal,economic, technical) still provides both positive and negative incentives for the optimal use of this resource. In a series of strategic papers on national and EU level resource efficiency is seen as an important contribution to securing raw materials and thus consequently as a central aspect concerning the supply situation in Europe, ranging from a complete self-sufficiency to a high import dependency.The final aim is to enhance the economic performance while reducing resource consumption at the same time leading to the central topic of reducing the absolute resource consumption. Nevertheless, especially within the waste management industry current regulations and Standard practice tend to stop at the idea of an environmentally friendly as possible disposal form.

Like all public international law treaties, the Paris Climate Accords rely on national law for their implementation. The success of the agreement therefore depends, to a large extent, on the stepstaken or not taken by national governments and legislators as well as on the instruments and mechanisms chosen for this task. Against this background, the present article compares different approaches to the implementation of the Paris Agreement, using court decisions as a means to assess their (legal) effectiveness.
