Needs the Waste Hierarchy to be Disposed?

Today the Directive 2008/98/EC on waste (Waste Framework Directive, WFD) governs waste legislation and policy of the EU Member States.

It shall apply as a priority order the following waste management hierarchy: (a) prevention; (b) preparing for re-use; (c) recycling; (d) other recovery, e.g. energy recovery;and (e) disposal.
Prevention and (preparing for) re-use seem to be excellent options as they follow a simple concept: if you create less waste, you consume fewer resources and you will have to spend less effort (e.g., money, energy) to recycle or dispose of your waste. In practice, the amount of waste is still growing and there is no clear indication for a de-linking of waste generation from economic growth. It is also evident that several directives on special waste streams such as packaging waste (Directives 94/62/EC and 2004/12/EC), waste of electric and electronic equipment (Directives2002/96/EC and 2012/19/EC) and end-of-life vehicles (Directive 2000/53/EG) demand quotas for separate collection, recycling and recovery but do not introduce binding targets for waste prevention and re-use.

Like all public international law treaties, the Paris Climate Accords rely on national law for their implementation. The success of the agreement therefore depends, to a large extent, on the stepstaken or not taken by national governments and legislators as well as on the instruments and mechanisms chosen for this task. Against this background, the present article compares different approaches to the implementation of the Paris Agreement, using court decisions as a means to assess their (legal) effectiveness.
