How stainless steel slag is handled legally in Austria is an example for the negligent use of the principals and guidelines laid down in the EU waste framework directive (WFD).
Saving resources and sustainable development lose their meaning when the question arises, if slag is a by productor waste. Environmental legislation is misused to make market politics that serve only a selected few. Economy and the environment suffer negative consequences. Waste legislation has a long tradition in Austria. This tradition led to the fact, that the waste industry became an important economic factor. A small but ever so important part of the waste legislation is the difference between waste and byproduct. Not in accordance to the decisions of the European Court of Justice (ECJ) the administration in Austria rules very much in favor of the waste status vs. the byproduct status of a material.

Like all public international law treaties, the Paris Climate Accords rely on national law for their implementation. The success of the agreement therefore depends, to a large extent, on the stepstaken or not taken by national governments and legislators as well as on the instruments and mechanisms chosen for this task. Against this background, the present article compares different approaches to the implementation of the Paris Agreement, using court decisions as a means to assess their (legal) effectiveness.
