More than ever automobiles are a major factor in the global economy with ongoing worldwide growth rates. In 2012 more than 1 billion passenger cars were registered, compared to 735 million in 2000. In 2011 about 80 million vehicles (passenger cars, trucks, busses) were produced, 18 million of these in China. In 2009 the former top-producers in the world, the USA (8.7 million) and Japan (8.4 million.) were surpassed by China in vehicle production.
At the beginning of 2012 more than 4.5 million passenger cars were registered in Austria; thus statistically, at any given time there are three available seats for each Austrian. In 2011 a record of 356,000 new passenger cars were sold in Austria in addition to more than 800,000 used cars; the total number of registered cars increased by 72,000 in 2011. However, only 80,000 cars were collected and treated as end-of-life vehicles in 2011. This means that more than 200,000 cars have statistically "disappeared" (more than 70 % - a new negative record for Austria) - most probably by unknown and illegal exports.
Since 2002 the deficiencies in the recovery of end-of-life vehicles in Austria significantly in-creased with the implementation of the EU-Directive 2000/53 on End-of-Life vehicles due to its cumbersome bureaucratic requirements and associated costs. The Austrian recycling industry applies the highest technical and environmental standards worldwide, but recovery is decreasing due to the questionable practice of exporting old vehicles - most probably to countries with significantly lower costs due to lack of environmental, social, and safety standards.
It is estimated that the EU has lost the valuable scrap of about 100 million vehicles due to questionable and unknown exports since the year 2002, when the (expensive) EU-Directive 2000/53 on End-of-Life vehicles was implemented in the Member States.

Like all public international law treaties, the Paris Climate Accords rely on national law for their implementation. The success of the agreement therefore depends, to a large extent, on the stepstaken or not taken by national governments and legislators as well as on the instruments and mechanisms chosen for this task. Against this background, the present article compares different approaches to the implementation of the Paris Agreement, using court decisions as a means to assess their (legal) effectiveness.
