The introduction of the five steps waste hierarchy in the current revision of the Closed Substance Cycle Management Act, the cessation of free allocation from 2013 on and the upcoming tightening of requirements in 17th Federal Immissions Control Decree cause increasing demands on co-incineration. These requirements include the precise determination of fuel consumption and property and the guarantee of a proper, safe and environmentally compatible utilisation. By using high quality solid recovered fuels high CO2 savings and a high efficient utilisation of the energy contained in waste are achieved. Within the framework of the new legal regulations the quality assurance can be used as "verification instrument".
Caused by the present changings in legal situation the German waste management must cope with numerous changes. The sector of solid recovered fuels must face not only the changes through the revision of the Closed Substance Cycle Management Law but through the Greenhouse Gas Emissions Trading Act and the amendment of the 17th Federal Immissions Control Drecree as well. In the present paper the resulting requirements shall be pointed out especially together with the chances for co-incineration and the possibilities of quality assurance as 'verification-instrumentâ€. By means of CO2 emissions and other factors like the biomass content and energy-efficient utilisation of solid recovered fuels in power plants and cement kilns, the 'high-grade†of coincineration of quality assured solid recovered fuels is explained.

Like all public international law treaties, the Paris Climate Accords rely on national law for their implementation. The success of the agreement therefore depends, to a large extent, on the stepstaken or not taken by national governments and legislators as well as on the instruments and mechanisms chosen for this task. Against this background, the present article compares different approaches to the implementation of the Paris Agreement, using court decisions as a means to assess their (legal) effectiveness.
