The White Book 'Waste-to-Energy in Austria†publishedby the Austrian Federal Ministry of Agriculture, Forestry, Environment and Water Management 2010 answers frequently asked questions. Due to the technological advancement both in incineration technology and flue gas cleaning with integrated treatment and recovery of residues, thermal processes now rank among the waste treatment methods with the lowest emission levels overall.
Waste incineration plays an important role in achieving greenhouse gas reductions and resource efficiency including energy recovery. Thus the pioneering experience in Switzerland as well as in Austria with a legal ban on disposal of organic wastes in landfills has become now a matter of global importance. However, the shipment of wastes suitable for energy recovery across borders poses currently a particular challenge, as environmental standards differ significantly across various EU Member States. Joint efforts will have to go into raising waste management in the EU and globally to a more uniform standard and into ensuring that Austria’s efficient thermal waste treatment plants can operate at full capacity. This is absolutely necessary in order to curtail global greenhouse gas emissions, comply with the legal obligations to conserve resources and increase energy efficiency, and thus reduce emissions across all countries.

Like all public international law treaties, the Paris Climate Accords rely on national law for their implementation. The success of the agreement therefore depends, to a large extent, on the stepstaken or not taken by national governments and legislators as well as on the instruments and mechanisms chosen for this task. Against this background, the present article compares different approaches to the implementation of the Paris Agreement, using court decisions as a means to assess their (legal) effectiveness.
