A periodic review of central developments in the area of climate regulation and the carbon market, covering legislative activities, high-level events, and new case law at the international and regional level.

More than any previous year, 2007 saw momentum build for concerted international action on climate change. With a lively public debate and several highprofile events, global warming enjoyed unprecedented media attention and also a prominent place on the political agenda as the year came to an end. Against this backdrop, more than 10,000 participants convened in Bali, Indonesia, from 3 to 15 December 2007 for the 13th Conference of Parties to the United Nations Framework Convention on Climate Change (UNFCCC) and the 3rd Meeting of the Parties to the Kyoto Protocol (KP). Altogether, delegates adopted 14 new decisions under the UNFCCC and 11 decisions under the KP, as well as a range of conclusions by the subsidiary bodies.1 Among the issues dealt with in these outcomes of the Bali summit are the adaptation fund, reducing emissions from deforestation in developing countries, technology transfer, as well as the flexible mechanisms of the KP. But by far the most attention was devoted to international cooperation beyond 2012, when the quantified emissions limitation and reduction objectives under the Protocol are set to expire.

Like all public international law treaties, the Paris Climate Accords rely on national law for their implementation. The success of the agreement therefore depends, to a large extent, on the stepstaken or not taken by national governments and legislators as well as on the instruments and mechanisms chosen for this task. Against this background, the present article compares different approaches to the implementation of the Paris Agreement, using court decisions as a means to assess their (legal) effectiveness.
