The Buffelsdraai landfill site is located some 35 km from the City of Durban in the north western reaches of the eThekwini Municipal area. The selection of the site was primarily because of the location of good geological conditions below the site comprising generally a sound intact tillite rock formation (Payne, 2005). The site is located within a sensitive water catchment area containing thousands of inhabitants of the local communities who use both surface and groundwater. The catchment ultimately drains into the Umhloti River which directly outlets into the Indian Ocean. The site opened in mid-May 2006 and initially receives the waste-stream that was originally accepted by the now closed La Mercy landfill site.
The management of landfill leachate in a tropical rainfall region requires a detailed water management plan and effective engineering intervention to ensure that leachate production from the landfill is minimised by efficient diversion of clean stormwater flows. The critical issue of separation of clean and dirty water within a landfill cell footprint during the various stages of its operational life and the early establishment of a leachate treatment plant can avoid expensive and potentially damning environmental effects. Therefore, the accurate staging of waste placement in engineered cells, and the method of landfilling, must each support the overall leachate and water management strategy on the landfill site. This paper describes the overall planning, engineering and development of a large leachate treatment plant for what is probably Africa’s largest new landfill facility - the 55Mm3 Buffelsdraai Landfill, located in the tropical region of Durban, South Africa.

Like all public international law treaties, the Paris Climate Accords rely on national law for their implementation. The success of the agreement therefore depends, to a large extent, on the stepstaken or not taken by national governments and legislators as well as on the instruments and mechanisms chosen for this task. Against this background, the present article compares different approaches to the implementation of the Paris Agreement, using court decisions as a means to assess their (legal) effectiveness.
