CIRCULAR ECONOMY IN GERMANY

Circular Economy (CE) is a future model of economic development which aims at environmental protection, pollution prevention and sustainable development through conversation, reusing and recycling of resources, in order to minimize pollution from the source and reduce overall waste per unit output. Germany started with a law “Kreislaufwirtschaft” in 1996 which is already a step forward to Circular Economy which in cooperates more than that what is covered by the German law.

In 1996 the German parliament passed the law on Kreislaufwirtschaft (Circular Economy). Circular Economy in China is defined as an "economic protection, pollution prevention and sustainable development, through resource saving, reusing and recycling in order to achieve pollution avoidance from the source and reduction of waste discharge per unit output". The task force was aware that a huge country like China is not easy to rule just by laws and regulations, therefore economics tools and instruments should be introduced like extended producer responsibility, environmental taxes, subsidized investments and interest costs, environmental funds for SMI’s etc. Both example show an interesting development but will Circular Economy help to solve the problem? Is it possible to solve the environmental problems with this approach?

Like all public international law treaties, the Paris Climate Accords rely on national law for their implementation. The success of the agreement therefore depends, to a large extent, on the stepstaken or not taken by national governments and legislators as well as on the instruments and mechanisms chosen for this task. Against this background, the present article compares different approaches to the implementation of the Paris Agreement, using court decisions as a means to assess their (legal) effectiveness.
