The Clean Development Mechanism (CDM) is one of the Kyoto Protocol’s flexibility mechanisms. As a project-based mechanism, it has a dual objective of reducing greenhouse gas (GHG) emissions, on the one hand, and contributing to the host countries’ sustainable development, on the other. Energy efficiency, especially end-use efficiency projects, create high sustainable development benefits, as they reduce energy poverty.
Furthermore, energy efficiency often generates emission reductions at low costs. Despite these advantages, projects relating to
energy efficiency are particularly under-represented in the portfolio of current or proposed CDM projects. The majority of Certified Emission Reductions (CER) stem from projects that generate high volumes of CERs and yield only few sustainable development benefits, such as emission reductions from landfills.

Like all public international law treaties, the Paris Climate Accords rely on national law for their implementation. The success of the agreement therefore depends, to a large extent, on the stepstaken or not taken by national governments and legislators as well as on the instruments and mechanisms chosen for this task. Against this background, the present article compares different approaches to the implementation of the Paris Agreement, using court decisions as a means to assess their (legal) effectiveness.
